TERMS OF USE

By using xginteractive.fun (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site. We may update these terms from time to time, as described in Section 12 below.

The Site is operated by Zafar, a sole proprietor based in India. XG Interactive is a brand name under which Zafar operates, not a separate legal entity.

You agree to use the Site only for lawful purposes. In particular, you agree not to:

• Attempt to bypass, disable, or interfere with any security feature of the Site (including the contact form's spam protection);
• Scrape, crawl, or systematically extract content from the Site other than through publicly documented means (e.g. /sitemap.xml);
• Use the Site to transmit anything unlawful, harmful, or abusive, including through the contact form; or
• Use the Site in any way that could damage, disable, or impair it, or interfere with anyone else's use of it.

You must be old enough to form a binding agreement in your jurisdiction (or have a parent or guardian's consent) to use the Site.

Purchases and downloads happen on third-party platforms — such as the Unity Asset Store, Fab, itch.io, Unity Play, or Steam — not on this Site. That platform's terms, pricing, and refund policy apply to the transaction, not these Terms. We are not the payment processor and are not responsible for a platform's availability, billing, or conduct.

Software we distribute may carry its own license terms provided at download. Where it does, those terms govern that product; these Terms govern only your use of the Site.

Our products are made without generative AI. This describes our process and is not a warranty or contractual guarantee.

The Site's design, text, graphics, logos, and code belong to Zafar unless stated otherwise, and are not licensed to you for reuse, redistribution, or republication. Downloadable products are governed by their own license (see Section 4).

The Site links to third-party platforms including itch.io, Unity Play, the Unity Asset Store, the Google Play Store, Discord, YouTube, Instagram, Web3Forms, and hCaptcha. We do not control and are not responsible for their content, policies, or practices. Linking is not an endorsement.

The Site and everything on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including — to the extent permitted by law — warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

To the maximum extent permitted by applicable law, Zafar will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Nothing in these Terms limits any liability that cannot be limited or excluded under the law that applies to you — for example, statutory consumer-protection rights in your country that these Terms cannot override.

You agree to indemnify and hold Zafar harmless from any claim or demand arising out of your misuse of the Site or your violation of these Terms.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and courts located in India will have jurisdiction over any dispute arising from them, except where applicable law gives you the right to bring a claim in your own country's courts (which this section does not take away).

We may revise these Terms. The "Last updated" date above will change when we do, and continued use of the Site means you accept the revised Terms.
